TERMS AND CONDITIONS
The following are the terms and conditions for use of the Easca Mattress website or any Internet site to which the Website is linked. This Website is for use by people who are 18 years and over only.
You agree to abide by all applicable local, state, national and international laws and regulations and are solely responsible for all acts or omissions that occur under your usage, including the content of your transmissions through the Website.
All information, designs, drawings and other specifications provided on the Website are the exclusive property of Easca Mattress. Any copying, transmission or re-transmission of the same requires the prior written approval of Easca Mattress.
PRICE OF GOODS
The price listed on the Website (the 'Price') for Easca Mattress products (the "Products") will be as stipulated at the time when you place your order on the website.
We are entitled to make adjustments to the price to take account of any increase in our supplier's prices, or the imposition of any new taxes or duties, or if due to an error or omission, the price for the products on the website is wrong.
While we try to ensure that all prices on the Website are accurate, errors may occur. If we discover an error in the price of products you have ordered, we will inform you as soon as possible and give you the option of reconfirming the order at the correct price or cancelling it. If we are unable to contact you, the order will be treated as cancelled and if you have already paid for the products you will receive a full refund.
ONLINE PRICING AND PROMOTIONS
Voucher/discount codes are only valid for mattresses for the dates specified and may be withdrawn at any time. Only one voucher/discount code can be used per order. Free pillows promotion is not eligible for monetary reimbursement, in the instance of a dual promotion, customer is eligible for alternative discount offered.
We will endeavour to deliver the Products to you within 3-7 working days of your account order within the island of Ireland , where this is practical. However, products are subject to availability and delays may sometimes occur that are outside of our control.
Any dates specified for delivery are therefore approximate only. If delivery is delayed for more than 21 days, you have the right to contact us and refuse to accept the products. In these circumstances, we will refund any money paid by you for those Products and any delivery monies you have been charged.
However, we will not be responsible for any other losses, costs, damages or charges that you may suffer if we delay in supplying or do not supply those Products. At the time of delivery you will be required to validly sign-off on the delivery of the Products, after which time the Products become your sole responsibility.
If you find that your order has only been partially delivered, this may be because other items are being despatched from a different location or we were out of stock on part of your order.
When you purchase a mattress online, you have a statutory right to return a Product up to 14 days after your order has been delivered (cooling off period). The Product must still be in it's original packaging and not been slept on, in that case the 14 day return policy does not apply and the customer is ineligible to return.
Your order can be changed or amended once it has been submitted. Changing or amending an order is only possible by cancelling the order and submitting a new order.
If the order has been dispatched, you can return the product to us and we will organise a refund (including delivery cost). Any breakages or damages must be reported within 24 hours of purchase/delivery.
Orders placed using a PayPal account as the payment method will be processed upon submission, and funds may be transferred from your PayPal account immediately. This does not signify our acceptance of your order.

ACCORDANCE WITH SPECIFICATION
All descriptive matter, drawings, pictures, colours, specifications and advertising on the Website are for the sole purpose of giving an approximate description of the products.
If any manuals, patient information or safety instructions are provided with the products, you agree to read and follow carefully all the terms contained therein at all times.
Any information contained on the Website is not meant to be comprehensive and if you are inexperienced in using the products or are unsure of your abilities, you should always seek expert advice and assistance.
100 NIGHT TRIAL POLICY
If within the first 100 nights of sleeping on your new Easca mattress you're not completely satisfied—for any reason—you may return it for a full refund. If outside the 100 nights you're not eligible for a refund.
All we ask to qualify for the 100 night trial is that you allow 3 weeks use. It can take a little bit of time for your mattress to break in, and for you to become acclimatised to it.
Your original mattress will likely be donated to charity. If a pickup of your Easca mattress is necessary, Easca will cover the related charges. Because we cannot handle international deliveries and logistics expenses, your mattress must be collected from it's original delivery address at the time you wish to take advantage of the 100 Night Trial Policy.
Please note that, in all cases, the original receipt showing proof of purchase may be required to take advantage of the 100-Night Trial Policy. To return your mattress, send an email to email@example.com along with a photograph of your mattress on your base and reason for the return.
This policy is limited to one return per household per year, and it must be exercised directly with Easca Mattress no later than the 100th day following delivery (or your personal possession) of the Product for which you want a refund.
As noted above, our 100-Night Trial Policy applies only to original purchasers of genuine Easca Products who purchased their product(s) directly from the website at eascamattress.ie.
The 100-Night Trial Policy does not apply to mattresses ordered in an incorrect size once the mattress has been removed from the original packaging. For this reason we recommend that you check the size needed before ordering and again before unpacking.
If a mattress is ordered in the incorrect size, the customer is liable to pay the full costs associated to replace it with the correct size. Including the cost of the replacement mattress, courier costs of collecting the incorrect size and delivering the new size.
If any of the 100-Night Trial Policy is breached the normal 14 day return policy applies, although a mattress cannot be returned under the 14 day return policy in any circumstances for a full refund if it's been removed from it's original packaging or been slept on.
The 100-Night Trial Policy does not apply to customers who raise a return within the 100-Night Trial window and who fail to follow up on proceeding with that return and who are now outside the 100 night trial period.
The 100-Night Trial Policy thus only applies during the period in which the Product is owned and controlled by the original purchaser of that Product. PLEASE RETAIN YOUR PURCHASE RECEIPT SO THAT YOU CAN PRESENT IT TO US IF NECESSARY.
DISCLAIMER 10 YEAR FULL REPLACEMENT LIMITED WARRANTY
Your new Easca Product is covered by a 10 Year Full Replacement Limited Warranty. For 10 years after you purchase your Product we will replace or repair it when it has a defect covered under the warranty. This includes all parts of the Product determined to have a defect.
This warranty is valid only if you are the original purchaser of the Product originally purchased from Easca Mattress and is non-transferable and starts on the date of Dispatch Confirmation. If a replacement mattress is deemed to be required, the replacement can only be delivered to address of original order (Within the island of Ireland). If you, as original purchaser, sell or otherwise relinquish ownership of the Product to another, the subsequent owner accepts the product “as is” and “with all faults.”
If you discover a defect in your Easca, email us firstname.lastname@example.org or give us a call at 076 680 5111 to let us know what the problem is. When emailing please attach a couple pictures to illustrate the problem.
Easca Products are engineered to deliver the best, most effective sleep possible. In order for that to happen, your Easca Product should be set-up on a solid base or foundation substantial enough to support the Product and occupant(s).
This Limited Warranty covers the following instances during normal use:
Deterioration of the Product resulting in a visible indentation greater than one (1) inch that is not associated with an indentation or sag as a result of an improper or unsupportive foundation or base. Normal wear requires that the Product be continuously supported by a matching, solid foundation, base, or frame substantial enough to support the Product and occupant(s).
Any physical flaw in the craftsmanship of the Product that causes permanent damage to the memory foam despite proper set-up and normal use.
Any physical flaw in the craftsmanship of the cover, including seams and zipper assembly. Easca may, at its own option, repair or replace the cover provided on the Product. In the event that Easca replaces the Product cover, Easca will replace it with the current style of cover available for the Product, which may be of a different colour, design, or material than the original cover provided.
This Limited Warranty does not cover, and will not apply to:
A normal increase in softness of the memory foam which is normal and does not affect the pressure-relieving quality of the Product.
Your comfort preference.
Physical abuse or damage to the structure and / or cover material of the Product, including but not limited to, burns, cuts, tears, liquid damage & stains, or soiling.
Damage to the Product arising from using an improper bed frame, foundation, platform bed, or adjustable base.
Replacement(s) of another piece in the Easca mattress, unless the other piece(s) is also defective.
Products sold by resellers who are not authorized retailers.
Products sold “as-is”, “preconditioned”, “reconditioned”, “used”, “comfort return”, “returned”, “previously owned”, or any other similar wording indicating that the Product is not “new” or of “first quality”, or has previously been purchased or used by another consumer.
Product Replacement Terms
Except as otherwise provided herein, Easca will not charge you to repair or replace your Product if it is deemed defective during the length of this 10 Year Limited Full Replacement Warranty. No new warranty or 100 night trial is provided on a replacement Product and you will be responsible for transportation and shipping costs associated with any further repairs or replacements. The warranty for the replacement Product runs from the date of Dispatch Confirmation for the original Product. In connection with the replacement of a Product in compliance with the terms of this Limited Warranty, if you elect to upgrade to a more expensive Product, you may do so by paying the difference between the cost of the original Product being replaced and the cost of the upgraded Product, plus the cost of any related additional sleep system pieces not being replaced as part of the warranty exchange. In the event of an upgrade as described in this paragraph, a new warranty will be provided for the upgraded Product and related additional sleep system pieces only. Easca is not responsible for the collection of any Product that is deemed defective under the 10 Year Limited Full Replacement Warranty.
Nothing in this 10 Year Full Replacement Limited Warranty will affect your statutory rights as a consumer in relation to the Product.
LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, under no circumstances, including, but not limited to, negligence, shall we be liable to you for any direct, indirect, incidental, special or consequential damages that result from the use of or the inability to use the Website, any changes to the Website, any material or data sent or received or not sent or received or for any of the above-mentioned damages that result from the use or inability to use the Products.
In no circumstances shall our liability and that of our suppliers to you and/or any third parties for any of the above exceed €200.
PROPRIETARY RIGHTS TO CONTENT
You acknowledge that content, including but not limited to text, software, music, sound, photographs, video, graphics or other material contained in either sponsor advertisements or email-distributed, commercially produced information presented to you by the Website, by us, or our advertisers or other content providers, is protected by copyrights, trademarks, service marks, patents or other proprietary rights and laws.
MODIFICATION OF TERMS
We shall not be liable for any failure to perform any of our obligations under these terms and conditions which is caused by circumstances beyond our reasonable control including, but not limited to any force majeure incident.
We may terminate the Website with or without cause at any time and effective immediately. In addition, we, in our sole discretion, may terminate your Account for violation of the letter or spirit of these terms and conditions.
